Rescissions the simple but hard truth:
Having a civil judgement against your name can cause a multitude of obstacles in your future. Be it in applications for credit, home loans or job applications. Such judgments are granted against a person in default.
The term default simply means that the court granted the judgment against a person without hearing that person’s version of events and/or they were not permitted to make any representations in respect of the plaintiff’s claim. This often occurs in situations where individuals for various reasons fail to appear before the court or fail to satisfy a variety of technical requirements in terms of the litigation process.
While this results in the court granting an unfavourable order against the individual, it is possible to reverse or overturn the judgment.
Typically this type of application is used where a bank obtains a default judgement and the debtor duly pays the outstanding debt. This payment extinguishes their claim, however it does not automatically remove the judgement against their name.
An attorney can make an application to have the order rescinded or revoked on the basis that the reason for the order no longer exists. Alternatively if there exists a genuine reason why the defaulting party was unable to make a representation in order to defend themselves in the action.
