Expert Drunk Driving Attorneys to Handle Your Defence

If you are in need of drunk driving attorneys, familiar with Section 65 of the National Road Traffic Act Number 93 of 1996, you have come to the right place. As criminal lawyers operating from our Morningside Sandton offices, we have years of experience in handling traffic offenses and also serious traffic violations. Our drunk driving attorneys are not here to judge clients, but rather to assist clients in defending their constitutional rights and to ensure that the clients are protected against unfair processes.

The two main offences regarding drunk driving according to the South African laws are that of driving a vehicle while under the influence of a narcotic or liquor which causes intoxication and where the concentration of such liquor in a blood specimen is 0,05 gram or higher for every 100 millilitres of blood. The second one is that of driving a vehicle under the influence of liquor where the breath specimen shows an alcohol concentration of 0, 24 milligrams or higher per 1000 millilitres.

Many times traffic officers don’t follow the correct procedures when stopping and testing a driver for drunk driving. Our drunk driving attorneys often defend clients exactly against such actions. Blood samples may for instance, only be taken within two hours of arrest. A blood sample not taken within such a period can thus not be valid. The traffic officer that operates the equipment when testing for drunk driving, must have an operator certificate of competence or a certified of copy of the certificate at hand when operating the equipment. The equipment used for the extraction of the samples must comply with the South African National Accreditation System and must be tested accordingly. All such equipment used must be calibrated every six months. It is also important that the traffic officer who operates the equipment has the calibration certificate at the site of testing.

Knowing the above, it becomes clear that you as the driver have specific rights such as the right to be tested by a qualified officer and within a specific timeframe with tested and calibrated equipment. Contact us today to have expert drunk driving attorneys handle your defence.
